G.S.R. (E).- In exercise of the powers conferred by sub-section (1) of section 9A of the Customs Tariff Act, 1975(51 of 1975) read with rules 18, 20, 22 and 23 of the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995, and in view of the Final order dated 06.11.2017 of the Hon’ble Madras High Court in respect of Writ Petition No. 12950 of 2017, the Central Government hereby makes the following amendments in the notification of the Government of India in the Ministry of Finance (Department of Revenue), No. 30/2017-Customs (ADD), dated the 16th June, 2017, published in the Gazette of India, Extraordinary, Part II, Section 3, Subsection (i), dated the 16th June, 2017 vide number G.S.R. 597 (E), dated the 16th June, 2017 namely:-
In the said notification, for para 3 the following shall be substituted:
“3. And whereas the Hon’ble High Court vide its Final Order dated the 6th November, 2017 has ordered that “The Writ Petitions are dismissed, leaving it open to the petitioners to avail the alternate remedy available to them under the Customs Tariff Act, as against the notification dated the 16th June, 2017, with a direction to the first Respondent to forthwith give effect to the notification”
4. Now, therefore, in view of the final order of Hon’ble High Court, the order keeping the notification No. 30/2017 dated the 16th June, 2017 in abeyance stands withdrawn and the notification is given effect to.”
