Exempts the Component and equipment for manufacture of trawlers
In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby exempts the components and equipment specified in the Table hereto annexed (hereinafter referred to as specified goods), when imported into India for manufacture of trawlers, from the whole of the duty of customs leviable thereon under the first Schedule to the Customs Tariff Act, 1975 (51 of 1975), and the additional duty, if any, leviable thereon under section 3 of the second mentioned Act, subject to the following conditions, namely :-
(i) the importer produces a certificate from the Empowered Committee on Fishing Trawlers, in the Ministry of Surface Transport, Government of India, indicating -
(a) the quantity and value of the specified goods and stating that the specified goods are required for the manufacture of trawlers;
(b) that the value of specified goods in the case of tuna long liners, purseseiners, squid jiggers and sterns trawlers does not exceed 35% of the cost price of the trawlers being manufactured out of such specified godos; and
(c) that the value of specified goods in the case of other trawlers does not exceed 30% of the cost price of such trawlers being manufactured out of such specified goods; and
(ii) the importer shall furnish an undertaking to the effect that -
(a) the specified goods shall be used for the purpose specified above;
(b) an account of the specified goods received and consumed in the place of manufacture for the aforesaid purpose shall be maintained in the manner specified by the Assistant Commissioner of Customs;
(c) he shall produce the extract of such account duly certified by the manufacture evidencing receipt of the specified goods in the premises of the place of manufacture within a period of 3 months or such extended period as the Assistant Commissioner of Customs may allow; and
(d) he shall pay, on demand, in the event of failure to comply with (a), (b) or (c) above, an amount equal to the difference between the duly leviable on such quantity and value of the said specified goods but for the exemption contained herein and that already paid at the time of importation.
Provided that nothing contained in this notification shall apply in respect of a manufacture of trawlers who is availing of the benefit of the notification of the Government of India in the Ministry of Finance (Department of Revenue) No. 33/91-Customs dated the 19th March, 1991.
2. This notification shall be in force upto and inclusive of the 31st day of March, 1995.
