EPCG (Zero & 10%) Scheme - (Supplies to Fertilizer Plants not to be counted towards E.O.) - Zero Duty EPCG -
(10% fall in minimum imports to be ignored)
G.S. R. (E):- In exercise of the powers conferred by sub-section (1) of the section 25 of Customs Act, 1962
(52 of 1962), the Central Government, being satisfied that it is necessary in the public
interest so to do, hereby makes the following further amendments, in the notifications of the
Government of India, in the Ministry of Finance, Department of Revenue, as shown in column 2 of
the Table below, as mentioned in column 3 of the said Table, namely :

In the notification mentioned against serial number 1, in Explanation, in clause(iv) and in the notification mentioned
against serial number 2, in Explanation, in clause (4)respectively the brackets and letter "(e)" shall be
deleted. |

In the notificationmentioned against serial number 3, in condition 5, for the third proviso, the following Proviso shall
be substituted, namely :-
"Provided also that the aforesaid conditions of minimum value of import which is
rupees twenty crores, or rupees one crore, or rupees ten lakhs, as the case may be, shall be deemed to have been
complied with where the shortfall in import is within 10% of the limits so prescribed." |

April, 1997 and lastly amended by notification No. 9/98 -Customs, dated 23rd April,
1998 (G.S.R.201(E), dated the 23rd April, 1998).
