Sub.: Filing of IGM in the prescribed format – P.N. No. 64/02 dated 30.5.02 – Reg.
Attention of importers/ Custom House Agents/ Steamer Agents/ Shipping Lines abd all other concerned is invited to the Public Notice No. 64/02 dated 30.5.02 issued by the Commissioner of Customs (G), New Custom House, Mumbai, regarding new format of IGM in Ondian Customs, EDI system. The new format of IGM has come into effect from 10.6.02. It is noticed that many of the Steamer Agents are filing only Part I (General decleration) as prior IGM and are taking IGM number and date. It is noticed that the Part II (Cargo decleration) and Part III (Container declaration) are filed by Steamer Agents only after arrival of vessel. Some of the Steamer Agents are filing IGM with only few details of Part II i.e. Cargo declaration. Because of this many of the importers/ CHAs are not able to file prior Bill of Entry in ICES.
2. All the Steamer Agents /Shipping Lines are hereby once again informed that whenever they file prior IGM, they should file all the three parts (Vessel details, cargo decleration and container declaration) together before submitting the IGM to the system. The Steamer Agents shall submit to the extent possible maximum number of lines of cargo declaration before taking the IGM number as per Para 2.3 of P.N. No. 64/2002. It may be noted that as per section 30(3) of the Customs Act, 1962, the A.C./ D.C. (Import Noting Department) will permit for addition of lines to import manifest only if there is no fraudulent intention. It is hereby informed that from 15.07.02 onwards the D.C. (Import Noting Department) will not give blanket permission for supplementary IGM in routing manner. It will be the responsibility of Steamer Agents to ensure that the permission from D.C. (Import Noting Department) is taken for addition of few lines which they could not submit at the time of taking IGM number.
3. All the Steamer agents are hereby informed that filing of prior IGM in parts will not be allowed from 15.7.02. If the Steamer Agents continue to file part IGM, then necessary action will be initiated under section 117 of Customs Act, 1962, In the meeting held on 02.07.2002 by the Commissioner of Customs (Import) with all the representatives of MANSA and CHA Association (BCHAA). The representatives of MANSA has agreed to ensure complete filing prior IGMs as far as possible for the vessel coming from following ports –
1. Singapore - 95%
2. Colombo & Dubai - 75%
3. Karachi & JNP - maximum number possible
However, it is noticed that still some of the Steamer Agents are not filing prior IGM with full details. In the meeting held on 09.07.02 by the Chief Commissioner of Customs, Mumbai in the presence of Commissioner of Customs (Systems), New Delhi, it was proposed to increase the fees of Rs. 20/- for amendment of IGM to Rs. 1,000/- per line to deter the tendency to apply for amendment of IGM instead of filing correct initially.
4. In an exceptional case where the Steamer Agents/ Shipping Agents/ Shipping Lines are not having all the details, for some genuine reason then they can file IGM as per Para 4 of the P.N. No. 64/02 dated 30.5.02 after arrival of the vessel, but within 24 hours of arrival of vessel as per section 30 of the Customs Act, 1962.
5. The permission for imported goods to be unloaded from the vessel as per section 30(1) of Customs Act, 1962 shall not be given by the Preventive Officer/ Supdt. ofn Customs in docks unless the compleete IGM has been filed by Steamer Agent in System. Similarly, no permission for break-bulk, will be given unless full IGM has been filed by Steamer Agents.
6. For filing the prior/ final IGM and to further dacilitate, the Steamer Agents are requested to file IGM in floppy format instead of data entry at Service Centre. The attention of Steamer Agents/ Shipping Agents/ Shipping Lines is invited to P.N. No. 65/02 dated 30.5.02 issued by Commissioner of Customs (G) in this regard.
