Amendment in the Bill of Entry

Attention of Trade Members including Importers and Custom House Agents is invited to para 18.4 of Public Notice No. 85/99 wherein procedure for amendment in the Bill of Entry where Out of Charge has been granted was prescribed.

In partial modification of the procedure prescribed in para 18.4 of Public Notice No. 85/99, it is notified that:-

The sub-para (iv) of para 18.4 may be read as "The permission of the concerned Additional/Joint Commissioner of Customs has been obtained".

Further, the following conditions should also be fulfilled by the importers while seeking amendment in a Bill of Entry after the Out of Charge has been passed:-

a. A Certificate from the jurisdictional Range Supdt. To the effect that MODVAT/CENVAT credit has not been claimed, against the importer’s copy of EDI Bill of Entry, is produced at the time of seeking amendment in the Bill of Entry.

b. A certificate from the concerned foreign exchange dealing Bank, to the effect that no remittance against the said Bill of Entry has been affected should also be produced.

The Group Asstt./Dy. Commissioner will ensure that the Bill of Entry is forwarded to the EDI Section for carrying out the amendment in the EDI System after recalling it from History-only after verifying that the conditions prescribed in para 18.4 of the Public Notice No. 85/99 read with this Public Notice have been fulfilled.
