Filling of IGM and changing Port of Call of Vessel - Procedure.
Representations have been received from Steamer Agents/ Shipping Agents/ Lines that they have facing difficulties in changing the declared port of call of the vessel from JNPT to MbPT and vice versa. It is also represented that due to port congestion or delays in berthing of the vessels scheduled to call at JNPT or MbPT , may attend/ call at Mumbai Port or JNPT. In order to facilitate the trade and meet the unforeseen compelling circumstances, the following procedure will be followed :
2. In the normal course, the Steamer Agents/ Shipping Agents/ Lines are required to follow the procedure of filling of IGM under the provisions of Section 30 of the Customs Act, 1962. Due to operational reasons, at times, the vessel may have to change the port of call or call at Mumbai Port/ JNPT for discharge of part or full cargo declared for discharge at JNPT / MbPT.
3. In order to mitigate the operational difficulties of the Trade and Steamer Agents/ Shipping Agents/ Lines in the matter of filling IGM and clearance of cargo, the following procedure may be followed :
A. In case, where vessel calls at JNPT and later calls at Mumbai Port for discharge of part / full cargo or vice versa :
i) In a situation, where the vessel initially calls at JNPT (1st port of call) and files IGM for the full cargo for discharge at JNPT and for operational reasons, vessel does not discharge full cargo and for port discharge of the cargo moves to Mumbai Port, the Steamer Agents/ Shipping Agents/ Lines shall also file an IGM in Mumbai Custom House (2nd port of call) in the EDI service centre of Import Department, Mumbai Custom House in the same manner, as stipulated in Public Notice No. 64/2002 dated 30.05.2002 and 82/2002 dated 12.07.2002 issued by Commissioner of Customs (General) and Commissioner of Customs (Import), Mumbai. This filling of IGM should be done prior to arrival of vessel in the Mumbai Port, as required under the provisions of Section 30 of the Customs Act, 1962.
ii) After filling of the IGM at 2nd Port of call for the cargo originally listed for discharge at 1st Port of call (JNPT/ MbPT) the Steamer Agents/ Shipping Agents/ Lines should inform the first port of call (i.e. JNPT/ MbPT) regarding cancellation of the IGM filed or for amendment in the IGM as may be required. While doing so the Steamer Agents/ Shipping Agents/ Lines should also inform the first port of call (such as JNPT/ MbPT) regarding discharge of full cargo declared for discharge at 1st port of call (say JNPT would be discharged at the 2nd port of call (say MbPT)
A copy of the IGM so filed by the Steamer Agents/ Shipping Agents/ Lines before 2nd port of call (say Mumbai Port/ Mumbai Custom House) Would be forwarded by them to 1st port of call (JNPT/ JCH) in support of due accountal of the un-discharged cargo at 1st port of call under the provisions of Customs Act, 1962.
iii) As a result of cancellation of IGM/ amendment of IGM for part discharge of the cargo, all the prior Bills of Entry noted against the prior IGM filed at 1st port of call (Custom House, Mumbai or JCH) shall automatically stand cancelled. Following the normal procedure, the importers/CHAs would file fresh Bills of Entry before JCH/ Mumbai Custom House, the 2nd port of call for clearance as per normal prescribed procedure.
B. Consignee insisting for delivery of cargo at original port as per Bill of Lading :
In the event, cargo is discharged at 2nd port of call (Mumbai Port/ JNPT) as against declared port of discharge as in the Bill of Lading say JNPT, or vice versa and the importer insists on taking delivery of the said cargo at original declared port of discharge, the Steamer Agents/ Shipping Agents/ Lines etc. may follow the existing procedure for transshipment of cargo to the original port of discharge as per Bill of Lading.
4. Similar procedure may be followed for discharge of cargo, which is originally covered by a vessel first calling at Mumbai Port and later vessel changes the port of call from MbPT to JNPT either without discharging the cargo or after discharging part cargo.
5. In case any difficulties are experienced, the procedure would be reviewed.
6. This Public Notice is issued with prior approval of the Chief Commissioner of Customs, Mumbai Zones - I & II.
