PUBLIC NOTICE – 52/2004, Date : 10.08.2004

Sub : ICES – Import – Declaration of brand, model, grade, Specifications or other relevant information necessary for Assessment at the time of filing Annexure I with CMC – reg.

Attention of all Importers, Exporters, CHAs and members of trade is invited to Public Notice No. 03/2002 dated 08.01.2002 or the above subject issued by this Commissionerate. It is noticed that inspite of the said Public Notice, a number of instances have been noticed wherein the information about the goods imported which is necessary for assessment are not being declared e.g.

(i) In case of pulses, the declaration of grade and size is necessary for determining the value which are not being declared.

(ii) In case of chemicals, it is noticed that the same are being imported by Trade names without declaring the chemical name which is essential to determine the value and classification.

(iii) In case of consumer goods like foodstuff, cosmetics etc, it is noticed that the unit of quantity is declared on per package basis. However, the amplification of the contents is not declared. It is further noticed that the description is declared by Brand name without amplifying the generic description of the item imported e.g. the description is declared as Toblerone without amplifying that the same is a chocolate.

(iv) Imports have been noticed where the description declared is merely Plastic Films / Sheets without declaring the type of plastic, grade, thickness etc.

(v) Imports of stainless steel sheets have been noticed wherein the grades have not been declared.

(vi) Imports of bearings and spare parts have been noticed wherein only part no., article no., is declared in the column for description without declaring the item imported.

(vii) In the case of imports of electronic components, vital specification like volts, watts, ratings etc are not being declared.

(viii) Writing ink is exempted from the levy of CVD while other inks are not. It is noticed that in case of imports of inks, the description declared is simply ‘INK’ without amplifying the description and exemption from CVD is claimed.

The above instances are inclusive and not exclusive. The lack of this information relevant of assessment leads to raising of avoidable queries and delay. In order to facilitate speedy clearance and improve the quality of assessment, it is reiterated that any information which is relevant for determination of classification, valuation, eligibility of Notification benefit etc should be duly declared in Bill of Entry filed under ICES.

This Public Notice comes into force with immediate effect.
