Sub. - Non-return of Customs passes of employees no longer working with the CHA/Importer/Exporter – reg.

1. Attention of all Custom House Agents is drawn to the provision laid down under Regulation 20(7) of the Custom House Agents Licensing Regulations, 1984 which envisages that the Custom House Agent shall exercise such supervision as may be necessary to ensure the proper conduct of any such employees in the transaction of business as agent and be held responsible for all acts or omission of his employees in regard to their employment.

2. Instances have come to notice of this office of employee ceasing to be in employment of the Custom House Agent/Importer/Exporter but the Customs Pass of the employee was not surrendered to the Department by the Custom House Agent as is required. Also, even after an employee ceases to be in the employment of the Custom House Agent/Importer/Exporter did not surrender the Customs Pass to the Custom House Agent/Importer/Exporter. The Pass is required to be surrendered immediately.

3. The Customs Pass is an identity card which allows a person to enter the restricted areas of Customs.

4. All the Custom House Agents/Importers/Exporters and employees of Custom House Agents /Importers/Exporters are directed to ensure that the Customs Pass is surrendered to the Department by the employer, as also to the employer by his employees soon after the concerned person ceases to be in employment.

5. It is brought to notice that any failure on the part of the Custom House Agent/Importer/Exporter and employees of the Custom House Agent/Importer/Exporter to comply with the aforesaid directions/instructions will be viewed seriously and shall invite adverse consequences under the CHALR, 1984.
