Declaration of R.C.D. at Cotton Green as Customs area.
In exercise of powers conferred on me under Section 8 of the Customs Act 1962, I K. P. Misra, Commissioner of Customs (General), Mumbai hereby rescind the Public Notice No. 21/2005 dated 12.05.2005 and declare the plot of land known as Railway Container Depot (RCD) located at Cotton Depot, Cotton Green, in the Sea Port of Mumbai and described in the schedule below, as a “Customs Area” for storing Import & Export cargo in Containers and other than loose cargo for transmission from/to Inland Container Depot (ICD), until further orders and subject to the following conditions:
1) The said Customs area shall remain under the custody of Mumbai Port Trust.
2) The Mumbai Port Trust shall provide adequate lightening and fire fighting equipment within and/or in the vicinity of the said area as a precaution against damage and fire.
3) The Mumbai Port Trust shall provide sufficient modern handling equipment in operational condition for handling the containers.
4) The Mumbai Port Trust shall make adequate arrangement for the safety and security of the import and export cargo.
5) The Mumbai Port Trust shall provide proper and adequate infrastructure facilities for Customs Officers within the aforesaid area at appropriate places and at the entry and exit gates of the aforesaid area.
6) The Mumbai Port Trust shall not charge any rent/demurrage on the goods detained by the Customs Department under the Customs Act, 1962 or any other Act for the time being in force.
7) No alteration of the plan in the accommodation, boundary wall and building, etc. shall be made without the concurrence of the Commissioner of Customs (General), Mumbai.
8) The Mumbai Port Trust shall abide by all the Rules & Regulations under the Customs Act, 1962.

Further, exercise of the power conferred on me by Section 45(1) of the Customs Act, 1962, I approve Mumbai Port Trust as a Custodian of the aforesaid Customs area in respect of all Import and Export cargo stored in containers for transmission from/to ICDs and order that the Custodian will be responsible for the statutory duties and responsibilities prescribed under Section 45(2) & 45(3) of the Customs Act, 1962.
All the members of the Trade, Importers Exporters, Steamer Agents and all concerned are hereby informed accordingly.
