PUBLIC NOTICE No.-05/2005 Dated: 23/02/2005
Sub: Discontinuation of removal of imported Petroleum Products from one Warehouse to another – reg.
1. It is notified for the information of trade, CHAs, Importers and others, especially those importing oil that it has been decided by the Govt. of India to withdraw the facility of transfer of petroleum (including crude) and petroleum products without payment of customs duty from warehouses at the port of import to inland warehouses under Section 67 of the Customs Act, 1962 (as amended), with effect from the midnight of 15.02.2005. Section 46 of the said Act provides for the importer to file the Bill of Entry for Home Consumption and clear the goods on payment of duty or to file Into-Bond Bill of Entry and warehouse the goods and clear them subsequently after payment of duty.
2. Henceforth, the warehousing facility for petroleum (including crude) and petroleum products would be available only at the port of import and no removal to inland bonded warehouse without payment of duty will be allowed.
3. Nothing in the above instructions would apply to goods which are exempted from payment of customs duty in terms of Customs Notifications or to goods imported by EOUs, STPs, EHTPs and SEZs.
4. This supercedes / modifies all previous Public Notices on this issue.
