Sub : Procedure for the disposal by auction/tender of seized, confiscated and time-expired goods
It is notified for the information of general public that the following procedure shall be followed with immediate effect for the disposal by auction or tender of seized, confiscated and time-expired goods by the Office of the Commissioner of Customs (General), Mumbai Zone – I.
(i) The disposal will be by electronic auction (e-auction) or by physical tendering which will be held on a prior notified date and time.
(ii) The prospective bidder for e-auction shall obtain registration on payment of a fee of Rs.25,000/- (which is refundable) and on filling in the details in the prescribed form, which may be obtained from the Disposal Unit of this office.
(iii) The e-auction will take place on the Mumbai Customs website (www.mumbaicustoms.gov.in) and an auction site could be accessed during the day and time notified for the purpose. The prospective bidders will be allotted the login ID and password upon registration.
(iv) The physical tendering will be by way of sealed tenders to be submitted to the Disposal Unit during the day and time notified.
(v) The details of the lots placed on e-auction or physical tendering will be placed on the Mumbai Customs website and on the Customs House Notice Board at least 3 working days prior to the date of auction. The goods will also be available for inspection by prospective bidders.
(vi) The bidder shall submit Earnest Money Deposit (EMD) of 10% of the bid amount in the form of demand draft or pay order payable to Commissioner of Customs, Mumbai. In respect of e-auction, the EMD shall be deposited before the close of the auction. In the case of physical tendering, the EMD shall be deposited along with the tender document deposited in the Disposal Unit of this Commissionerate.
(vii) The e-auction/physical tendering will be closed at the end of the time notified for the purpose. The bids of e-auction will be tabulated in the presence of witnesses. Similarly the sealed tender documents will also be opened in the presence of witnesses immediately after the closing.
(viii) The results of e-auction or physical tendering will be announced after two hours of the close of the auction/tendering.
(ix) The successful bidder shall deposit the full bid amount within 5 working days and shall take delivery of the goods, failing which the EMD is liable to be forfeited.
2. The Commissioner of Customs (General) may withdraw any lot from the auction or tendering at any time or cancel the same at any stage prior to the delivery of the goods.
