Implementation of MOU between India and Mozambique for import of pigeon peas and other pulses grown in Mozambique - reg.
Vide Notification No 19 dated 5.8.2017, import policy of Pigeon Peas (Cajanus cajan)/Toor Dal under EXIM Codes: 07136000, 07139010 and 07139090 was revised from 'free' to `restricted' and imports were subject to an annual (fiscal year) quota of 2 lakh MT as per the procedure notified. The notification had also laid down that this restriction will not apply to Government's import commitments under any bilateral/regional Agreement/MOU.
2. In this regard, as per Article 3 (2) of the Memorandum of Understanding between the Government of the Republic of Mozambique and Government of the Republic of India on cooperation in the field of production and marketing of pigeon peas, both parties have agreed to target export of 1,25,000 MT of pigeon peas and other pulses grown in Mozambique to India during 2017-18.
3. Till now, around 40,000 MT has already been imported from Mozambique. Accordingly, only 85,000 MT is to be imported further. The remaining quantity will be allowed for import subject to following conditions:
a. Import will be allowed only through the following 5 ports: (i) Mumbai, (ii) Tuticorin, (iii) Chennai, (iv) Kolkata, and (v) Hazira
b. Import will be subject to production of "Certificate of Origin" certified by the authorized signatories with stamps provided by the Government of Mozambique, which is being shared with the concerned Customs authorities of the above ports and CBEC.
c. While providing the Origin Certificate (including details exporter, importer and quantity of pulses), the designated authority will send a scanned copy of the certificate to import-dgft@nic.in and shyama.roy@nic.in. The importer here in India will send a mail to DGFT with scanned copy of the certificate issued as above, for NOC on the same e-mail address as above, i.e., import-dgft@nic.in and shyama.roy@nic.in. DGFT will compare both these documents and allow NOC to the applicant, based on which Customs will clear the consignments.
d. For shipments in the transit, the importer will be required to get NoC from DGFT based on the Origin Certificated issued to him by the Mozambican Authority. The Customs will clear consignments only on getting NOC from DGFT.
