[Paragraph 11 E.5]

Declaration in compliance with Section 31(4) of the Foreign Exchange Regulation Act, 1973 in respect of immovable properties held in India as on 1st January 1974 by individuals

Instructions:

1.

The declaration should be submitted in duplicate either to the Chief General Manager, Exchange Control Department [Foreign Investment Division (iii)], Reserve Bank of India, Central Office, Mumbai - 400001 or to the Office of the Reserve Bank within whose jurisdiction the property is situated.

 

 

2.

Please give clear and complete particulars against each item. Where any particular item is not applicable, please write N.A. against it.

 

 

3.

If space is not sufficient for giving full information/particulars against any of the items, a separate sheet may be attached to the declaration and serially numbered as an annexure.

 

 

4.

A separate form should be used for each immovable property.

 

 

5.

Declarants wishing to dispose of or transfer immovable properties by way of sale, lease (for a period exceeding 5 years), mortgage, gift, etc., should submit application in prescribed form (IPI 2) for permission under Section 31(1) of the FERA 1973 to the Chief General Manager, Exchange Control Department, [Foreign Investment Division (iii)], Reserve Bank of India, Central Office, Mumbai - 400 001.

A photo-copy of the power of attorney duly certified by a Solicitor/Advocate should be submitted if the declaration is signed by the attorney of the declarant.
