FORM B-8- (SECURITY)

Bond (with security) to be entered into by person licensed to obtain without payment of the whole or part of the duty, excisable goods to be used for special industrial purposes

I/We ______________________________of _________________hereinafter called the obligor(s) am/ are Jointly an severally bound to the President of India, in the sum of ______________rupees to be paid to the President of India for which payment I/ we Jointly an severally bind myself/ourselves and my/our legal representatives,

The above bounden obligor(s) having been permitted by the Commissioner of Central Excise ___________hereinafter called the Commissioner to purchase from time to time such quantities of ____________as may be required, not exceeding _________per year, for use in the factory at _____________for the manufacture of the commodity(ies), and in the manner, specified in his/their application No._________________ dated _____________without payment of the whole or part of the duty.

Whereas the Commissioner has required the obligor(s) to deposit as guarantee for the amount of this bond, the sum of __________________rupees in cash

the securities as hereinafter mentioned of a total face value of rupees __________________ endorsed in favour of the President of India and accepted on his behalf by the Commissioner, Deputy Commissioner or Assistant Commissioner or Superintendent of Central Excise, namely :-

And whereas the obligor(s) has/have furnished such guarantee by depositing with the Commissioner the cash/securities as aforementioned.

The condition of this and is that if the obligor(s) shall not make any change in the nature or manner of manufacture specified in his/their application or use the ________________________for any purpose other than that stated in the application without the prior approval of the Commissioner;

And shall observe all the provisions of the Central Excise Rules, 1944, and all such amendments thereto, as may be issued form time to time so far as they relate to the use of excisable goods for industrial purposes without payment of the whole or the part of the duty;

And if all dues, whether excise duty or other lawful charges, which shall be demandable on the goods obtained by the obligor(s) without payment of the whole or part of the duty or transported from the place of procurement to the premises of the obligor(s) as shown by the records of the proper officer of Central Excise], be duly paid into the treasury to the account of the Commissioner within ten days of the date of demand thereof being made in writing by the said Officer of Central Excises;

This obligation shall be void.

Otherwise and on breach or failure in the performance of any part of this condition, the same shall be in full force.

And the president of India shall, at his option, be competent to make good all the loss and damages either from the amount of the guarantee deposit or by enforcing his rights under the above written bond or by both.

I/We declare that this bond is given under the orders of the Central Government for the performance of an act in which the public are interested.
