General Bond (with security) for provisional assessment of goods
to excise duty

(Rule 9B)

I/We _______________of ______________hereinafter called the obligor(s) am/ arejointly and severally bound to the President of India hereinafter referred to asthe Government in the sum of ___________rupees to be paid to the Government forwhich payment. I/We jointly and severally bind myself / ourselves and my / ourlegal representatives.

Whereas final assessment of excise duty of _________________hereinafter called the goodsmanufactured/cured/warehoused at ___________by the obligor(s) from time to timecould not be made for want of full information as regardsvalue/description/quality or of proof therefore or for the non-completion of thechemical or other tests in respect thereof or otherwise.

And whereas the obligor(s) desires/desire that the Government should makeprovisional assessment of excise duty of the said goods pending final assessmentas per provisions contained in Rule 9B of the Central Excise Rules, 1944;

And whereas the Commissioner has required the obligor(s) to deposit as guarantee forthe amount of this bond the sum of ____________________ rupees in cash;

the securities as hereinaftermentioned of a total face value of rupees _______________ endorsed in favour of the President ofIndia and accepted on his behalf by the Commissioner, Deputy Commissioner,Assistant Commissioner or Superintendent of Central Excise, namely: -

And whereas the obligor(s) has/have furnished such guarantee by depositing with theCommissioner/Deputy Commissioner/Assistant Commissioner/Superintendent the cash/securities as aforementioned;

Now the condition of this bond is that the said obligor(s) shall observe all theprovisions of the Central Excise Rules, 1944, and all amendments thereto, as maybe issued from time to time, so far as they relate to such provisionalassessments;

And if the said obligor(s) shall furnish the said information or the said proofwithin such period as may be fixed by the proper officer;

And if all dues, whether excise duty or other lawful charges which shall bedemandable in respect of such goods on the basis of the value, description orquality as ascertained after final assessment by the proper officer be duly paidinto the treasury to the account, of the Commissioner within ten days of thedate of demand thereof being made in writing by such officer;

This obligation shall be void.

Otherwise and on breach or failure in the performance of any part of this condition thesame shall be in full force.

And the President shall, at his option, be competent to make good all the loss anddamages either from the amount of the guarantee deposit or by enforcing hisrights under the above written bond or by both.

I/We declare that this bond is given tinder the orders of the Central Government forthe performance of an act in which the public are interested.
