Adddition in Chapter 4 in Table B under Schedule 2 of ITC(HS) (0402)

S.O.(E) In exercise of the powers conferred by Section 5 of the Foreign Trade (Development & Regulation) Act, 1992 (No.22 of 1992) read with Para 1.3 and Para 2.1 of the Foreign Trade Policy, 2004-2009 , the Central Government hereby makes the following amendments in the ITC(HS) Classifications of Export and Import items, 2004-2009 as amended from time to time.

2. With immediate effect the following new entry may be inserted after entry at Sl.No.33 in Table B under Schedule 2 of ITC (HS) : -

Dairy produce; bird's eggs; natural honey; edible products of animal origin, not elsewhere specified or included


Note 1 The expression “milk” means full cream milk of partially or completely skimmed milk

2. The above amendment shall remain in force till September 30, 2007.

3. The transitional arrangements under para 1.5 of the Foreign Trade Policy, 2004-2009 (updated as on 7th April, 2006) shall not be applicable for export of the aforesaid items. The export of SMP under ITC(HS) Code-04021010 to the extent of 300 MT to Nepal by NCCF as per the work order given by the Ministry of External Affairs and 50 MT to Bhutan on humanitarian considerations is exempted from the restrictions imposed through this Notification.

Any issue regarding the discharge of existing export obligations will be examined on case by case basis.

(In para 3 the sentences at the end has been included vide NTF. NO. 03/2007, DT. 01/05/2007)

Further, following exports are exempted from restrictions imposed by this Notification:

3.1 75 MT of milk powder under ITC (HS) Code 04021090 and 50 MT of milk powder under ITC (HS) Code 04022990 to Bhutan by Nestle India;

3.2 200 MT of SMP under ITC (HS) Code 04021010 to Myanmar by GCMMF, Gujarat; and

3.3 28 MT of SMP under ITC (HS) Code 04021010 and 8.1 MT of Milk Food for babies under ITC (HS) Code 04021020 / 04022920 to Afghanistan by GCMMF, Gujarat.

(Above 3.1 to 3.3 has been added vide NTF NO. 21/2007, DT. 13/08/2007)

Further, following exports are exempted from restrictions imposed by this Notification:

3.1         1,000 MT of milk powder under ITC (HS) Code 04021010 to Bangladesh by GCMMF,        Gujarat;
