PUBLIC NOTICE NO 71/2000 Date :- 08.06.2000

Sub :- Movement of import cargo in containers at Railway Container Depot- Reg.

1. Time and again procedure regarding movement of import containers / transshipment containers have been clarified through various public notices / circulars. However, it has been reported that certain agencies such as CONCOR have sought clarification with respect to movement of import / transshipment containers through Railway container Yard on railway wagons. Standing Order No. 7129/95 dated 15.9.95 envisages that all the containerised cargo ( imported as well as exported ) should be sealed with tamper proof bottle seals and the sealing of containerised import / export cargo should be done by Appraising / Preventing Officers, as the case may be, and the serial number of Customs bottle seal be indicated in the examination report / Transshipment Permit / Bill of Entry / Forwarding Challan and other related documents.

2. Circular No. 40/95 dated 10.11.95 is explanation of Standing Order No. 7129/15.9.95. vide this, sealing of containers which move within the docks are to be allowed with the Shipping Agent"’ bottle seal, if it was put at load port and the number mentioned in Bill of Lading and Import Manifest is tallied.

3. Public Notice No. 86/99 dated 3.8.99 issued by Chief commissioner of Customs illustrates procedure for transshipment of containerised imported goods from J.N.Port / NSICT to another port and foreign port etc. In this, transport of imported containerised cargo by rail / road to another port in India has been discussed in detail, wherein it is clearly mentioned that in case of transshipment by rail, an aircraft, a vessel or a motor vehicle, the proper officer shall seal the containers with Customs Departments’s seal

Further, attention is invited to the "Goods Imported ( Conditions of Transshipment ) Regulations, 1995", wherein Section 6 (1) emphatically says that " Before the goods imported are transshipped, the proper officer shall : (a) in case of transshipment by rail, seal the containers with Customs Department’s seal."

5. Therefore, there is no need for further clarification of the matter. Yet, once again it is reiterated that containers which are moving out of the jurisdiction of this Commissionerate and all transshipment containers moving out of docks area and ICDs, are necessarily to be sealed with tamper proof Customs bottle seals and such bottle seals be put by the proper officer of Appraising / Preventive Department, as the case may be.

6. The tamper proof bottle seals shall be issued by the Assistant Commissioner of Customs, i/c Docks Appraising. The Assistant Commissioner of Customs, Docks Appraising shall specify the charges payable by the importers / exporters / CHAs / Steamer Agent and others in respect of Customs bottle seals from time to time. As such, the cost of bottle seals have to be borne by the port using agencies.

This is issued for strict compliance in letter and spirit by all the agencies working within the jurisdiction of this Commissionerate.
