In exercise of the powers conferred under Paragraph 1.03 of the Foreign Trade Policy(FTP) 2015-20, the Director General of Foreign Trade (DGFT) hereby makes amendments to the proforme for End Use Certificates (EUC) [Appendix 2S(i), 2S(ii) and 2S(iii)], notified vide Public Notice No. 04/2015-20 dated 24.04.2017 and No. 07/2015-20 dated 17.05.2017, under para 2.74 of the Handbook of Procedures (HBP) of the Foreign Trade Policy (FTP) 2015-20, with immediate effect.

2. The existing EUC proforme, namely, Appendix 2S(i), 2S(ii) and 2S(iii) prescribed under para 2.74 of the Handbook of Procedures (HBP) of the Foreign Trade Policy (FTP) 2015-20 are substituted with the Annexed proforme.

3. The EUC proforme and their applicability to export authorisation for various categories of items under SCOMET Control List is illustrated as under:
 

*Stock and Sale is not permitted for SCOMET Category 0, Category 3A4001, Category 6 and transfer of technology in any category

4. The EUCs in prescribed proforme are to be filled by all the entities involved in the chain of supply e.g. foreign buyer / consignee / end user / intermediary(ies) on the letterhead of the respective entity, duly signed in ink and stamped by the authorised signatory of the company. In case of any additional sheet used alongwith the EUC, the same must be on the letterhead of the company and signed by the same person who signs the EUC.

5. Effect of this Public Notice:.

The amendment in proforme of End Use Certificate will capture technical details of product, specific end use and complete contact details of the end user, thereby facilitating expeditious end use / end user verification by the Government agencies and grant of export authorisation for SCOMET items..

Explanatory note for export of software and technology:

1. For export of software and technology in Part 2, a letter of explanation detailing the following be provided alongwith FUC (letter to be signed by the same person who signs the EUC):

■ The exact project location where the technology will be used;

■ The type of technology to be exported or re-exported;'

■ The technology value addition such as upgrade/update, support, specific customisation of software

■ The form in which the export or re-export will be made;

■ The uses for which the data will be employed.

2. If the technology value addition is carried out by the Indian exporter, then the following additional details are required to be provided by the Indian exporter on its letter head alongwith application:

An explanation of the process, product, specification (catalogue), size and output capacity of all items to be produced with the technology, if applicable, or other description that delineates, defines, and limits the data to be transmitted (the "technical scope"); and the availability abroad of comparable foreign technology.
