Deemed Export [EXIM Policy 1988-91]-Supplies to Sardar Sarovar Narmada Project
Sub: Continuance of deemed export benefits under para 190 (f) and 220 (3) of the Import and Export Policy, 1988-91 for Supply of Turbine and Motor Generator Sets for River Body Project House of House of Sardar Sarovar Narmada Project in the wake of withdrawal of OECF funds.
Attention is invited to Para 190 (f) and Para 220 (3) of the Import and Export Policy, 1988-91 in terms of which indigenous supplies to Projects financed by multilateral/bilateral external agencies were eligible for deemed export benefits.
2. Representations have been received for continuance of deemed export benefits to the supply of Turbine and Motor Generator Sets for River Body Project House of Sardar Sarovar Narmada Project as mentioned above in the wake of withdrawal of OECF funding.
3. The matter has been considered and it has been decided that :-
(i) All contrats awarded/Letter of Intent issued by Sardar Sarovar Narmada Nigam Ltd. Prior to the date of suspension of OECF fund on 25.11.1990 would be entitled to the deemed export benefits that existed on this date.
(ii) The benefits under the deemed export policy, as stated above, shall be available for supplies made during the contracted period of the delivery schedule which also include the extended period of delivery schedule by the Project Authority for execution of the Project.
(iii) Where supplies in respect of contracts, as contained in Para 3(i) & (ii) above have already been completed on the date of issue of this Public Notice, such contracts shall not be eligible for grant of Advance licence for deemed export unless such licence had already been applied for prior to effecting the aforesaid supplies.
