PUBLIC NOTICE NO. 36(RE-2002)/2002-2007, Dt. 17/09/2002.

Subject: Import of
Deleted [OLD- raw ]Garlic against export of Garlic products under Duty Exemption Scheme.

(Pl. refer ALC Cir. No. 02/2002-03, Dt.03/12/2002 - Import of garlic against Export of garlic products under Duty Exemption Scheme for Condition)

The issue of grant of advance licences for import of Deleted [OLD- raw ] garlic against export of garlic products has been engaging the attention of the DGFT Head office for quite some time. The matter has been examined.

(The word “Raw” appearing in the subject heading and in the first paragraph of the said Public Notice has been deleted vide PN No. 52/2002-07, Dt. 05/12/2002)

2. For the notice of general public and RLAs, the Director General of Foreign Trade, in exercise of powers conferred on him under paragraph 2.4 of the Export and Import Policy 2002-2007, as notified in the Gazette of India extraordinary, part-II Section 3, Sub-section (ii) vide S.O. No. 349(E) dated 31.3.2002, here by notifies that the advance licences under para 4.7 of the Handbook of Procedures, Vol 1 (1st April, 2002-31st march, 2007) for import of garlic against export of garlic products shall be issued by the Regional Licensing Authorities with

    (i) prior import condition, and

    (ii) the condition that the weight of Allicin content in import and export should match with a variation of +/-2% on the basis of Chromatographic profile of import and export item.

( Partial modification of above P.N. with effect from the date of its issue, the accountability of imported garlic in the under mentioned garlic export products shall be governed by the conditions indicated against each:-

    a) Dehydrated/dry garlic (range 7.2% to 8.8% Moisture)- Recovery 33.5%
    b) Dehydrated/dry garlic (range 5.9 % to 7.1% Moisture)- Recovery 32.5%
    c) Garlic flakes and powder ( range 5.2% to 6.3% Moisture) Recovery 30%

For other garlic products or where exporters face difficulties ALC shall decide accountability.

3. The RLAs shall continue to process such applications and issue advance licences under para 4.7 of the Handbook of Procedures, Vol. 1 (1st April, 2002-31st march, 2007) along with the above endorsements and thereafter continue to forward the same to the ALC in the Head office as per the Policy provisions and procedures laid down for this purpose, for finalization of norms.
