Public Notice No.28(re-99)/1997-2002 dated 18-08-1999

In exercise of powers conferred under paragraph 4.11 of the Export and Import Policy, 1997-2002, as notified in the Gazette of India Extraordinary, Part-II- Section 3-Sub- section (ii) vide S.O. No.283(E) dated 31.3.97, the Director General of Foreign Trade hereby makes the following amendment in the Handbook of Procedures (Vol. 1) (RE-99), 1997-2002.

1. Paragraph 12.15 shall be amended as under:

The exporter eligible for golden status certificate in terms of paragraph 12.14 of the Policy shall submit a simple request the self attested photocopies of previous three certificates alongwith an irrevocable declaration regarding claiming of SIL on NFE / FOB basis. They will be required to surrender current and valid recognition certificate, if any, held by them on date. Such applications shall be filed with Directorate General of Foreign Trade.

2. In appendix-19, 19A and 19B, at the end of the Chartered/Cost and Works Accountants/Company Secretary's certificate, the following, shall be added:

3. Following shall be added as paragraph 12.8(A) after paragraph 12.8:

12.8(A) The exporters who were holding recognition certificate for the period 1998-99, under Export Import Policy 1997-2002 or under Exim. Policy 1992-97 and have also obtained recognition certificate under the current Policy have an option to claim SIL based on exports made during preceeding licensing year subject to following conditions:

(a) The irrevocable option shall be exercised at the time of filing the application for recognition which shall be endorsed on the certificate at the time of its issuance;

(b) The exports made prior to 1st April 1997 shall be entitled for SIL in accordance with the provisions contained in Export Import Policy 1992-97 and in accordance with the rate and procedure prescribed in Handbook of Procedure (Vol. 1)- 1992-97;

(c) Application against exports made on or after 1st April 1997 shall be filed in the form given in Appendix-20D and shall be entitled for SIL against export proceeds realised on an annual basis during preceding licensing year;

(d) The application for SIL shall be filed within a period of six months from the end of the licensing year or 90 days following the grant of renewal/recognition certificate whichever is later;

(e) The provisions contained in paragraph 12.8(e) shall also be applicable;

3. The following shall be added at the end of first paragraph of paragraph 7.4(C):

"Applications in such cases shall be considered only on the basis of NOC to be obtained from the Narcotics Commissioner of India, Central Bureau of Narcotics, Gwalior.

4. The following shall be added as an agency in Appendix 5 1 B under the heading 'Rajasthan' in the list of Agencies Authorised to issue Certificate of Origin- Non Preferential.

5. Mewar Chamber of Commerce & Industry, Bhilwara.

6. The word and expression "Hazira" appearing in the list of Sea Ports given in paragraph 7. 19 may be corrected to read as "Surat (Magdolia)".

7. The following shall be added at S.No.4 & 5 in Appendix-19B and 55 under the heading "Documents to be enclosed with the application form"

(4) Copy of the FIRC issued by the bank in respect of foreign exchange received from service rendered.

(5) Copy of the balance sheet filed with Income Tax Authorities for the relevant year.

Corrigendum:

8. The description of export product given in paragraph 10(e) of Public Notice No.27 dated 12th August, 1999 shall be corrected to read as "Rennet Casein/Acid Casein (Industrial grade) having protein content 80-85%".

9. The following shall be added at S.No. (c) of Appendix-56 relating to application form for green card under the heading "Documents to be enclosed with the application form".

(c) Three copies of photograph duly attested in respect of each person for whom the green card is applied. One photograph shall be pasted on the top of the application form whereas two copies to be enclosed with the application form.

9. The following shall be added at S.No.23 of Appendix-32B in the list of IS/ISO 9000 (series) certification agencies.
