Eximkey - India Export Import Policy 2004 2013 Exim Policy
PUBLIC NOTICE NO. 70(RE-98)/1997-2002 dt. 5th February, 1999
 

In exercise of powers conferred under paragraph 4.11 of the Export and Import Policy, 1997-2002, as notified in the Gazette of India extraordinary, Part-II-Section 3-subSection (ii) vide S.O. No. 283(E) dated 31.3.97 the Director General of Foreign Trade hereby makes following amendments in the Handbook of Procedures (Vol. 1) (RE-98), 1997-2002.

  1. Paragraph 5.41(v) shall be amended to read as under :

    "Food-stuffs, medicines, clothing and blankets received by any charitable organisation, registered with Ministry of Welfare and Ministry of Home Affairs under Foreign Contribution Regulation Act, as a gift from any philanthropic organisation or person abroad, for free distribution either by itself or other charitable organisations to the poor and needy without any distinction of caste, creed or colour".
     
  2. The following shall be added at the end of paragraph 15.15:

    "However, wherever the Policy provisions have been modified to the disadvantage of the exporters, the same shall not be applicable to the consignments already handed over to the Customs for examination and subsequent exports upto the date of the Public Notice."
     
  3. The word "Proforma Invoice" appearing in S.No. 3 of the list of documents prescribed at the end of the Appendix 10A and 10B shall be amended to read as "Proforma invoice/quotations".
     
  4. The following shall be added as an agency after S. No. 17 under list of IS/ISO 9000(series) certification agency of Appendix 32B.

  5. The second sentence of paragraph 4 of Appendix 44 shall be amended to read as follows :

    "The Software Technology Parks/complex set up by the central government, state governments, public or private sector undertakings or any combination thereof, duly approved by the Inter-Ministerial Standing Committee and Software Technology Parks of India may also import free of duty all types of goods, for creating central facility for use by the software development, data entry and conversion, data processing, data analysis and control or data management units in the complex."
     
  6. The paragraph II-A (C) of Appendix 42 shall be amended to read as follows :

    "The DTA sale of plain jewellery shall be permitted on payment of concessional rate of duty in Indian rupees as applicable to sale from nominated agencies, in respect of studded jewellery, duty shall be payable in Indian Rupees as notified by Customs.
     
  7. The format of Memorandum of Understanding as given in Appendix 19A notified under Public Notice No. 46 dt. 7.10.98 stands deleted and replaced as per the Annexure A attached with the public notice.
     

Corrigendum to Public Notice No. 62(RE-98)/1997-2002 dt. 24.12.98

1. In paragraph 8, the word "S. No. 734" may be corrected to read as "S. No. 733".

Corrigendum to Public Notice No. 29(RE-98)/1997-2002 dt. 10.8.98

1. In S. No. 7, the word 'paragraph 7.35' shall be corrected to read as 'paragraph 7.36'.

Annexure A

Memorandum of Understanding

This MOU has been made on _____________________________________ day of 19 ___________________.

BETWEEN

Government of India acting through Director General of Foreign Trade (herein referred to as DGFT) Udyog Bhavan, New Delhi.

AND

M/s ________________________________________ (hereafter referred to as party which expression shall be deemed to include their executors, successors, administrator and assignee)

1.
Whereas the party has sought issuance of a Star/Super Star Trading House certificate (strikeout whichever is not applicable); and
2.
Whereas the party intends to achieve an export turnover of Rs._________ (the threshold limit of Star/Super Star trading house, as applicable); over a period of next three years.
3.
Whereas the DGFT has agreed to recognise the party as a Star/Super Star Trading House, (as applicable) and extend all benefits conferred upon similar status holders as per Export Import Policy and procedures on this date and as amended henceforth. Henceforth, for the purpose of SIL related benefits, it would be on the basis of actual export performance.
