HB Vol.1 - Appendix 28A amended/ added - DEPB Rate list


In exercise of powers conferred under paragraph 4.11 of the Export and Import Policy, 1997-2002, as notified in the Gazette of India extraordinary, Part - II - Section 3 - Sub - section (ii) vide S.O. No. 283(E) dated 31.3.97. the Director General of Foreign Trade hereby makes following amendment in the Handbook of Procedures (Vol.I) (RE-98), 1997-2002.

The rates notified under Annexure A shall cover the exports made from 1.4.97 to 14.4.98.

The rates notified in Annexure B to this Public Notice will from part of Appendix 28A and shall cover the exports made from 15.4.98.

1. The description of export product at S.No. 259 of Engineering product shall be amended to read as "Casing and tubings / hollow drill roads / capling / core barells and substitutes made out of carbon steel seamless tube pipe".

2. The description of export product as given in Appendix 28A at S.No. 880 of chemical products shall be amemded to read as "3.3 Dichloro Benzidine, D-Hydorchloride".

3. The description of export product as given in Appexdix 28A at S.No. 579 of chemical products shall be amemded to read as " Ink blue concentrate Acide blue 93 C. L. No. 42780. "

4. The description of export product as given in Appexdix 28A at S.No. 579 of chemical products shall be amemded to read as " Alkali blue (Pigment Blue 61) C. L. No. 42765.1".

5. The value cap of export product as given in Appendix 28A at S.No. 91 and 363 of Engineering product shall be amended to read as under:

6. The description of export product as given in Appendix 28A at S. No. 1, 2 and 3 of Fish & Fish products may be amended to read as follows:

1. Dried marine products, live crustaceans. aquarium or ornamental Fish and Fish & Marine products including frozen meat thereof, not covered under S. No. 2 and 3 below.
2. Processed, preserved and frozen Fish and Crustaceans, Mollusces and other Aquatic invertebrates excluding those covered under S. No. 1 & 3.
3. Processed, preserved and frozen headon / headless shrimps of species Black Tiger (Penaeus monodon) white shrimps (Penaeus Indicus) and scampi.


Note: 1. The exporter exporting the products mentioned in S.No. 2 above, shall be required to give a specific declaration in the Shipping Bill to the effect that the preservatives, as prescribed in Standard Input Output Norms relating to fish and marine products, have been used in the export product.

2. The exporter exporting the products mentioned in S.No. 3 above, shall be required to give a specific declaration in the Shipping Bill stating that the export products have been obtained from aquaculture sources.

7. The DEPB rate for export product as given in Appexdix 28A at S. No.3 of Fish & Fish products may be amended to read as 10%. The enhancement in the above DEPB rate shall be effective from 15.4.98. and shall cover exports of such products made on or after 15.4.98.

8. The serial number Fine / Fancy leather gloves as given under the product group leather in Public Notice No. 10 dated 1.5.98. shall be corrected to read as S. No. 31 instead of S.No. 10.

9. The description of export product as given in S.No. 46 of product group Textile in Public Notice No. 6(RE-98) dated 15.4.98. shall be amended to read as "Grey/bleached/ dyed and / or printed fabrics manufactured out of spun yarn from man-made fibre ".

10. The description of export product as given in S.No. 590 of product group chemicals in Public Notice No. 6 (RE-98) dated 15.4.98 shall be amended to read as " Neoprene based adhesive ".

11. The description of export product as given in S.No. 590 of product group chemicals in Public Notice No. 6 (RE-98) dated 15.4.98 shall be amended to read as " Vinyl create based adhesive ".

12. The DEPB rate for export product as given in S.No. 486 of Engineering product in Public Notice No. 6(RE-98) stands deleted.

13. The description of export product as given in S.No. 728 of chemical product in Public Notice No. 6 (RE-98) as emended from time to time is modified to read as under:

" CIS + Hydroxy Lactam / CIS (+)-2-(-4-Methoxy Phenyl)-3-Hydroxy-2, 3-dihydro-1, 5-Binxothia-zepin-4-(5H)-one"

This issues in public interest.

Export obligation = 1.5 x CIF value of the HW imported including software + 1.5 x wage bill.

Notes: The obligation on the hardware (HW) part will be fulfilled over a period of four years. The obligation is also applicable on the software imported.

The obligation on the wage bill is on annual basis.

Net Foreign Exchange for this purpose is governed by the definition given in the Software Policy announced in 1986 which states:

"Net Foreign Exchange earned for this purpose is defined as foreign exchange inflow as a result of software exports less foreign exchange outflow on account of expenditure other than initial hardware and/or software imports.

This issues in public interest.
