HB Vol.1 amended - EH, EOU, Appendix 51B, 20E, 11, 20B, 20D, 19A


In exercise of powers conferred under paragraph 4.11 of the Export and Import Policy, 1997-2002, as notified in the Gazette of India extraordinary, Part-II- Section 3 - Sub- section (ii) vide S.O No. 283(E) dated 31.3.97, the Director General of Foreign Trade hereby makes following amendment in the Handbook of Procedures (Vol.1) (RE-98), 1997-2002:

1. Paragraph 12.2(a) shall be amended to read as as follows:

"For grant / renewal of any status, the application shall be filed latest by 30th November,1998. Deficiency, if any, must be communicated by the licensing authorities by 15th December. If this is not done, then existance of deficiency and non rectification thereby by 31st December will not be treated as a ground for rejecting the application. The applicant shall be required to submit the rectification of deficiency to the licensing authorities by 31st December. Any application where deficiencies are rectified thereafter shall be rejected out rightly".

2. The following may be added as paragraph 7.25 (iv) after the paragraph 7.25(iii):

However, in case of supply to EOU / EPZ under Special Imprest Licence, DEEC exports shall be endorsed by Customs / Central Excise Authority located within the zone / unit.

3. Sub-paragraph of paragraph 7.4(c) shall be amended to read as follows:

"Copies of such applications shall also be simultaneously endorsed to the Drug Controller of India, Nirman Bhawan, New Delhi, Narcotics Commissioner, Central Bureau of Narcotics, Gwalior. and the respective Zonal Director of the Narcotics Control Bureau alongwith a declaration that the applicant will maintain the records and also submit the prescribed records / returns"

4. The following agencies may be added at the respective sub heading in Appendix 51B:

5. The column 4 of Appendix 20E shall be amended to read as follows:

"No. and date of quality certificate of ISO 9000 (series) or IS / ISO 9000(series) or number and date of WHO-GMP certificate or No and Date of HACCP certificate and name and address of issuing authority".

6. The following may be added at the end of sub paragraph 3 of note 2 of Appendix 11.11, paragraph 11.11A, paragraph 12.8(c) and paragraph 14.3.

"The applicant shall have an option to file the application for grant of SIL on yearly basis against export proceeds realised during April-March in respect of exports made on or after 1.4.97 "

7. The following may be added after column 4 in Appendix 20B, 20D, and:

"/FOB value of exports proceeds realised against exports made on or after 1.4.97 (during April-March)".

8. The following may be added after column 7 in Appendix 20D:

"/The CIF value of all licences issued (licensing yearwise) plus 2.5 times of the DEPB value issued plus CIF value of duty free gold / silver / platinum obtained from nominated agencies both by me and my Subsidiary Company except EPCG licences, Special Import Licence and licences surrendered within the period of their validity is Rs.________ during April-March ______"

9. The following may be added as paragraph 12.12 after the paragraph 12.11:

"Manufacturing companies or industrial houses eligible for recognition as Star trading house andsuper star trading house in terms of paragraph 12.12A of Exim Policy shall file an application in Appendix -19A alongwith an Memorandum of Understanding (MOU). Such status holder, however, shall be entitled for SIL benefit based on the eligibility criteria prescribed for Export House/Trading House / Star Trading House / Super Star Trading House. Therefore, while issuing the status certificate, a specific endorsement shall be made regarding issuance of SIL in the prescribed category of status on NFE / FOB basis.

The existing Export House / Trading House may also apply for above recognition, if eligible, subject to the above condition.

10. The following may be added as Appendix 19A after Appendix19:

Memorandum of Understanding


This MOU has been made on ____________________ day of 19 ________.

BETWEEN

Government of India acting through Director General of Foreign Trade (herein referred to as DGFT) Udyog Bhavan, New Delhi.

AND
M/s _______________________________ (hereafter referred to as party which expression shall be deemed to include their executors, successors, administrator and assignee)

1. Whereas the party has sought issuance of a Star/Super Star Trading House certificate (strikeout whichever is not applicable); and

2. Whereas the party intends to achieve an export turnover of Rs._________ (the threshold limitof Star/Super Star trading house, as applicable); over a period of next three years.

3. Whereas the DGFT has agreed to recognise the party as a Star/Super Star Trading House, (as applicable) and extend all benefits conferred upon similar status holders as per Export Import Policy and procedures on this date and as amended henceforth. Henceforth, for the purpose of SILrelated benefits, it would be on the basis of actual export performance.
