PUBLIC NOTICE NO.17/(RE-98)/1997-2002, DATED 22/6/1998
ITC (HS) Classification - Export of Weapons grade Chemical - Negative list of ExportAttention is invited to the Ministry of Commerce Notification No. 7/1997-2002 dated 22ND June, 1998 according to which the entry appearing at S.No.28 in Chapter 16, Negative List of Exports, Part II, Paragraph 16.2 Restricted items (exports permitted under licence) of the Export and Import Policy, 1997-2002 has been amended.
2. In exercise of the powers conferred under Paragraph 4.11 of the Export & Import Policy, 1997-2002, the Director General of Foreign Trade hereby makes the following amendments in Schedule 2 Appendix 1 of the book titled "ITC (HS) Classification of Export and Import Items 1997-2002".
3. The following entry shall be added as S. No.37 in the Schedule 2 Appendix 1 of the book titled "ITC (HS) Classification of Export and Import Items 1997-2002".
"37. | Chemicals included in Schedule 3 to the Chemical Weapons Convention of the United Nations, as specified at S.Nos. xv to xxxi in Schedule 2 Appendix 5 of the book titled "ITC (HS) Classification of Export and Import Items" when exported to state parties to the Chemical Weapons Convention. | Export allowed subject to the conditionthat exporter shall notify the National Authority, Chemical Weapons Convention, Cabinet Secretariat and the Directorate General of Foreign Trade of such exports in prescribed format (Appendix 18 B, as reproduced in the Handbook of Procedures, 1997-2002) along with the End UseCertificate within 15 days of the actual export. |
4. Export of Schedule 3 Chemicals, as specified above, to States not party to the Chemical Weapons Convention shall continue to be restricted against export licences in terms of entry appearing at S.No. 28 of Paragraph 16.2 of the Negative List of Exports.
