Grant of Advance Licenses on Self-declaration basis in respect of applications forwhich Standard Input Output Norms are not fixed.
Attention is invited to SAW Circular No. 1/1999-2002 dated 28th June, 1999 on theabove subject.
2. Pursuant to the decision taken in the Port Officers Meeting held on 15th & 18thJuly, 1999, it has been decided to amend the last sentence of Paragraph 2 of theaforesaid SAW Circular to read as under:-
"It is hereby clarified that apart from ensuring that the applications arecomplete in all respect, the licensing authorities are required to see that the applicant is not seeking to misuse the facility under Paragraph 7.5 of the Handbook of Procedures, 1997-2002, Vol. I (RE: March 1999)".
3. Attention of all licensing authorities is further invited to Para 3 of the above mentioned
SALC Circular No. 1 dated 28th June, 1999 whereby apart from other things the licensing authorities were also required to forward complete set of applications alongwith prescribed documents, both for issuance of advance licence (Appendix 11B) and for fixation of norms (Appendix 11 A) alongwith a copy of licence.
In partial modification of above, it has now been decided to dispense with the requirement of Appendix 11 A as the same is not provided under Paragraph 7.5 of the Hand Book of Procedures, 1997-2002, Vol. I (RE: March 1999).
4. Attention of all licensing authorities is also invited to Paragraph 7.8 of the EXIM Policy 1997-2002 (RE: March 1999) relating to fixation of Standard Input Output Norms for grant of duty free licences in accordance with the published norms. In the said Paragraph 7.8 of the policy, it has also been laid down that in respect of goods for which Standard Input Output Norms have not been published, the norms will be as specified by SALC. In accordance with the above provisions, SALC has been recommending fixation of both Standard Input Output Norms and ad-hoc norms with a validity of certain period where Standard Norms cannot be fixed. In this connection it is clarified that wherever applications for advance licences are made as per such ad-hoc norms fixed by SALC and within the validity period as prescribed by SALC in terms of Paragraph 7.5 of Hand Book of Procedure on self-declaration basis, the same shall be considered by licensing authorities in normal manner till the validity of such norms without resorting to the provisions of Paragraph 7.5 of the Hand Book of Procedures, 1997-2002 (RE: March 1999) and licences issued accordingly. Such applications need not be subsequently forwarded to Headquarter for fixation of norms.
5. All other instructions contained in the aforesaid SALC Circular No. l/ 1999-2002 dated 28th June, 1999 shall remain unchanged.
