Circular No.111/1995 date 18/10/95

Sub:- Goods Imported (Conditions of Transhipirtent) Regulations, 1995 - Regarding

Notification No. 61/95-NT-Customs dated 28th Sept., 1995, notifying the Goods Imported (Conditions of Transhipment) Regulations, 1995 has been issued on 28th Sept., 1995. This notification replaces the earlier Regulation of 1984 viz, Imported Goods (Conditions of Transhipment) Regulations, 1984. The new.Regulations makes following changes vis-a-vis the 1984 Regulation:

(a) Imported Goods (Conditions of Transhipment) Regulations, 1984, did not provide as to who can make application for transhipment of imported goods. In the new Regulation it has been provided that application for transhipment of the imported goods can be made either by the master of vessel/aircraft, the steamer agent, a consolidation agent, a container agent or any other person duly authorised in this behalf by the foreign supplier or his agent.

(b) Under the 1984 Regulations there was no specific provision for the transhipment of goods by two or more modes of transport. Under this Regulation it has been provided that such transhipment can be by more than one mode of transport also. For example it would now be possible to tranship the goods from Bombay Air Port to ICD at Pune, by Air up to Pune Air Port and by Road to ICD at Pune or by Road or Rail from Bombay to Pune. So far such transhipment were being made only by road.

(c) The 1984 Regulations provided for the transhipment of the goods against a bond to be given only by the railways/airlines, shipping company or the person incharge of motor vehicle. In the new Regulation it has been provided that a bond could be given either by the applicant, the transporter or even by the custodian of the goods at the ICD/CFS to which the goods are being transhipped.

(d) The fee for transhipment has been raised from Rs. 5/-to Rs. 20/- for each application.

2. Please issue a suitable SO and P.N. for information of all Departmental officers and Trade Interests. Doubts, if any, may be referred to Board under intimation to Commissioners of major Customs Houses.
